The Canadian Border Services Agency (CBSA) has the authority to detain (i.e. arrest) a foreign national or permanent resident.

Reasons the CBSA will detain you include:

  • there is reason to believe you are a danger to the public,
  • you have not appeared at a hearing or are unlike to comply with a removal order,
  • the government finds that you are inadmissible, or
  • a border officer feels you have not established your identity.

Within 48 hours of being detained, you will be called to a court hearing called a detention review.

During a detention review, you and a representative of the CBSA must argue whether you should remain in detention, be removed from Canada, or be released from detention.
